2. How to Submit a Copyright Infringement Notice (Takedown Notice)
To submit a valid DMCA takedown notice, your written communication must include all six of the following elements (17 U.S.C. § 512(c)(3)):
1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf. 2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works). 3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on our site (e.g., a URL). 4. Contact information for the complaining party: name, address, telephone number, and email address. 5. A statement that the complaining party has a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law. 6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the exclusive right allegedly infringed.
Send your notice to the Designated Agent above. Incomplete notices will not be processed.
3. How to Submit a Counter-Notice
If you believe material was removed or disabled by mistake or misidentification, you may submit a counter-notice that includes:
1. Your physical or electronic signature. 2. Identification of the material that was removed and the location where it appeared before removal. 3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification. 4. Your name, address, and telephone number. 5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the U.S., the jurisdiction of any judicial district in which SpartaDesign360 may be found), and that you will accept service of process from the person who provided the original infringement notification.
Send your counter-notice to the Designated Agent. Upon receipt of a valid counter-notice, we may restore the material in 10 to 14 business days unless the original complainant files a court action.
4. Repeat-Infringer Policy
SpartaDesign360 will terminate, in appropriate circumstances, the accounts of users and clients who are determined to be repeat infringers of copyright. We reserve the right to make this determination in our sole discretion.
5. Client-Supplied Materials
Clients who upload, provide, or supply content, images, logos, text, video or other materials to SpartaDesign360 for use in their projects represent and warrant that they own or have all necessary rights and licenses to those materials and that their use does not infringe any third-party copyright, trademark, or other intellectual property right. Clients agree to indemnify, defend, and hold harmless SpartaDesign360 and Sparta Media Solutions LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from client-supplied materials.
